    This Terms of Service Agreement ("Agreement") is entered into between Water Blasting Nelson ("we," "our," "us") and the client ("you," "your," "client") who engages our water blasting services in Nelson, New Zealand and surrounding areas.

    Water Blasting Nelson is serviced by Buckingham Contracting Ltd. In this Agreement, references to Water Blasting Nelson, we, our, or us include Buckingham Contracting Ltd as the company responsible for providing the services, issuing invoices, and meeting the obligations set out in these terms.

    Please read these Terms of Service carefully before scheduling or using our services. By engaging our services, you agree to be bound by these terms. If you do not agree with any part of these terms, please do not use our services.

    Acceptance of Terms

    By scheduling our water blasting services, you acknowledge that:

    • You have read, understood, and agree to be bound by all terms and conditions outlined in this Agreement.
    • You are at least 18 years of age and capable of entering into a legally binding agreement.
    • You have the authority to permit Water Blasting Nelson to enter the premises where services will be performed.
    • You understand these terms apply to all current and future service engagements unless superseded by a new agreement.

    This Agreement constitutes the entire understanding between you and Water Blasting Nelson regarding the services provided and supersedes all prior agreements, representations, and understandings between us related to the subject matter herein.

    Service Description

    Scope of Services

    Water Blasting Nelson provides professional water blasting and exterior cleaning services throughout Nelson, New Zealand and surrounding areas. Our standard services include:

    • High-pressure and low-pressure water cleaning of residential and commercial buildings
    • Driveway, path, and concrete surface cleaning
    • Deck, fence, and timber structure restoration
    • Gutter and spouting cleaning
    • Commercial building washing
    • Dairy farm and agricultural facility cleaning
    • Safe removal of dirt, grime, moss, mould, and algae

    Service Limitations

    While we strive to provide exceptional service using professional cleaning methods, please be aware of the following limitations:

    • We cannot guarantee complete removal of all stains, particularly those that have deeply penetrated porous surfaces or are caused by rust, tannins, or chemical reactions
    • Some surfaces may have pre-existing damage or deterioration that becomes more visible after cleaning. We will conduct a pre-service assessment and notify you of any concerns
    • Extremely old, worn, or deteriorated surfaces may require special treatment or may not be suitable for high-pressure water blasting
    • Surfaces with structural damage, loose materials, or unstable substrates may not be suitable for our cleaning process
    • Heritage buildings, historic surfaces, and delicate materials require specialist assessment and may not be suitable for standard water blasting
    • We do not provide pest control or structural repair services. If such issues are discovered, we may recommend specialist contractors
    • Weather conditions may affect service scheduling and results. We will not proceed if conditions are unsafe or unsuitable

    Client Preparation

    To ensure optimal service delivery and safety, you agree to:

    • Clear the working area of any movable items, furniture, vehicles, pot plants, and outdoor equipment
    • Ensure all windows and doors are closed and secured before service commences
    • Remove or secure any items that could be damaged by water spray or runoff
    • Ensure clear access to the areas requiring service, including removal of any obstacles
    • Provide access to an external water supply and power outlet (if required)
    • Inform us of any known hazards, underground services, or special concerns about your property
    • Secure all pets indoors and keep children away from the work area during service
    • Notify us of any fragile landscaping, delicate plants, or garden features near the work area
    • Ensure adequate parking and safe property access for our technicians and equipment
    • Inform us if the property has any heritage protections, special coatings, or requires council consent

    Scheduling & Cancellations

    Appointment Booking

    You may schedule service by email or through our website. All appointments are subject to availability in the Nelson service area. We will provide you with an estimated arrival window of 2-3 hours.

    Cancellations & Rescheduling

    We understand that circumstances change. Our cancellation policy is as follows:

    • More than 24 hours notice: No cancellation fee; full refund of any prepayments
    • 24-12 hours notice: 50% cancellation fee or option to reschedule once at no charge
    • Less than 12 hours notice: 75% cancellation fee or rescheduling fee of $25
    • No-shows: Full service charge applies with no refund

    Weather-related cancellations by Water Blasting Nelson will be rescheduled at no additional cost, or a full refund will be provided at your request.

    Service Delays

    While we strive to maintain our schedule, occasional delays may occur due to traffic, weather conditions, or service complications at previous appointments. We will notify you as promptly as possible of any significant delays. If our technicians are delayed more than 60 minutes beyond the estimated arrival window, you may be eligible for a 10% discount on your service.

    Payment Terms

    Pricing & Estimates

    Service prices are based on surface type, size, condition, and additional services requested. We will provide a price estimate before service begins. The final price may change if:

    • Additional services are requested during the appointment
    • Undisclosed conditions are discovered that require additional treatment
    • The surface size or type differs from what was described during booking

    You will be consulted before any additional charges are incurred.

    Payment Methods

    We accept the following payment methods:

    • Credit/debit cards (Visa, MasterCard)
    • Cash (NZD)
    • Bank transfer or internet banking
    • Electronic payment services (PayPal, Stripe)

    Payment is due in full upon completion of services unless prior arrangements have been made for commercial accounts.

    Late Payments & Returned Checks

    For commercial clients with approved payment terms:

    • Invoices are due within 15 days of service
    • A late fee of 1.5% per month will be charged on overdue balances
    • Returned cheques will incur a $25 dishonour fee

    Service Warranty

    Satisfaction Guarantee

    We stand behind our work with a 7-day satisfaction guarantee for all residential services in the Nelson area. If you are not completely satisfied with our water blasting service, we will return to re-treat the areas of concern at no additional charge, subject to the following conditions:

    • The request for re-treatment must be made within 7 calendar days of the original service
    • The area has not been re-soiled or damaged
    • No new soiling or damage have been introduced
    • The concerns relate to the specific services we performed

    Warranty Limitations

    Our warranty does not cover:

    • Stains we specifically identified as potentially permanent during the service
    • Issues arising from pre-existing damage to surfaces
    • Reappearance of stains due to deep penetration in porous materials
    • Damage to surfaces that were already compromised before service
    • Normal wear and aging of materials
    • Any conditions not directly related to our cleaning services

    Note: This warranty is provided to the original service recipient at the address where services were performed and is non-transferable.

    Limitation of Liability

    Standard of Care

    While Water Blasting Nelson strives to provide the highest quality water blasting services, we cannot guarantee:

    • Complete removal of all stains or discoloration
    • Total elimination of all moss, mould, or biological growth
    • Resolution of all surface damage or deterioration
    • Prevention of future soiling or biological growth

    Damage Limitations

    In the event of property damage directly caused by our technicians during the provision of services:

    • You must notify us within 24 hours of service completion
    • We reserve the right to inspect any alleged damage before accepting liability
    • Photographic evidence of the damage must be provided where possible
    • Our liability is limited to repair or replacement of the specific damaged item(s)
    • Our maximum liability shall not exceed $10,000 NZD or the amount paid for the services, whichever is lower
    • We are not liable for damage caused by pre-existing defects, structural weaknesses, or concealed issues not reasonably detectable during our service

    Legal Liability Limitation

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WATER BLASTING NELSON SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

    • YOUR USE OR INABILITY TO USE OUR SERVICES
    • ANY PRE-EXISTING CONDITIONS OF YOUR SURFACES OR PROPERTY
    • ANY REACTIONS TO CLEANING METHODS
    • ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN

    IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU TO WATER BLASTING NELSON FOR THE SERVICES PROVIDED.

    Disclaimers & Notices

    Health & Safety Disclaimer

    While our water blasting services can improve the appearance and cleanliness of surfaces, we make no claims or guarantees regarding health outcomes. Our services are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Property owners should take appropriate precautions during and after service.

    Service Area

    Our services are currently limited to Nelson, New Zealand and surrounding areas. We reserve the right to decline service to locations outside our designated service area or to modify our service area at any time without notice.

    Force Majeure

    Water Blasting Nelson shall not be liable for any failure to perform its obligations under this Agreement if such failure results from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemic restrictions, civil unrest, terrorist acts, labour disputes, or governmental actions.

    Photography & Promotional Use

    We may take "before and after" photos of treated areas to document our work. These images may be used for training, quality control, and marketing purposes. If you prefer your property not be photographed or used in promotional materials, please inform us in writing before service commences.

    Quality Standards & Care

    Water Blasting Nelson operates to professional standards using proven techniques and equipment. Clients should inform us of any concerns about their property structure before work begins. We conduct thorough assessments and are not liable for damage to property that is not structurally sound or has concealed defects not visible during our initial inspection.

    Environmental Compliance

    All water blasting services are conducted in compliance with New Zealand environmental regulations and Nelson City Council bylaws. We take reasonable precautions to minimise environmental impact, including proper waste water management.

    Health & Safety

    We operate in accordance with the Health and Safety at Work Act 2015. Clients must inform us of any known hazards on the property, including asbestos, lead paint, underground services, or other hazardous materials. We reserve the right to cease work if unsafe conditions are discovered. Additional charges may apply if hazardous materials require specialist handling.

    Access Requirements

    Clients must provide safe and clear access to all areas requiring service, including access to water supply and power if required. You are responsible for securing pets and ensuring children are kept at a safe distance during operations. We require at least 3 metres of clear working space around all areas to be treated.

    Consumer Guarantees Act 1993

    Nothing in this Agreement is intended to exclude, restrict, or modify the application of the Consumer Guarantees Act 1993 where it applies. Our services come with guarantees that cannot be excluded under New Zealand consumer law. For commercial services where the Consumer Guarantees Act does not apply, the terms of this Agreement shall apply in full.

    Dispute Resolution

    In the event of any dispute arising from these Terms or our services, both parties agree to first attempt to resolve the matter through good faith negotiation. If a resolution cannot be reached, disputes may be referred to the Disputes Tribunal (for claims under $30,000 NZD) or mediation before initiating legal proceedings. This Agreement is governed by the laws of New Zealand.

    Intellectual Property

    All content on our website, including text, graphics, logos, and images, is the property of Water Blasting Nelson and is protected by New Zealand and international copyright laws. You may not reproduce, distribute, or create derivative works from our content without express written permission.

    Changes to Terms

    Water Blasting Nelson reserves the right to modify these Terms of Service at any time. Changes will be effective upon posting to our website or direct notification to clients. Your continued use of our services following such changes constitutes your acceptance of the modified terms.

    We recommend reviewing these terms periodically. Material changes will be communicated to active clients via email or written notice. The most current version of our Terms of Service will always be available on our website.

    This Agreement is governed by and construed in accordance with the laws of New Zealand. Both parties submit to the non-exclusive jurisdiction of the New Zealand courts.
